1. How to enter the Contest:
- 2008 Pontiac Solstice 2-Year Lease Giveaway contest will begin on March 24, 2008 at approximately 8: 00 AM and end on May 2, 2008 at 5:00 PM.
To participate in the contest, visit Borcherding Automotive in the Kings Automall at 9737 Kings Automall, Cincinnati, OH 45249 and pick up a candy bar or mail your name, address, city, state, zip code and phone number on a 3” x 5” card to Borcherding, 9737 Kings Auto Mall Road, Cincinnati, OH 45249.
2. Eligibility Restrictions:
a. The contest is open to anyone who is 18 years of age or older as of May 2, 2008. Employees of Borcherding Enterprises, their respective affiliated entities, the respective advertising agencies, other participating sponsors and/or promotional partners, other radio stations in the Greater Cincinnati metropolitan area and the members of their immediate families and households are ineligible to participate or win.
b. Listeners are eligible to win a contest only once every seven (7) days for prizes
valued at or below $25.00; once every thirty (30) days for prizes valued at or between $25.01 and $300.00; once every six (6) months for prizes valued at or between $300.01 and $1,000; and once every year for prizes valued at or above $1,000.01 Only one (1) winner per household is permitted in any contest.
c. Grand Prize Winner must be a U.S. licensed driver and Grand Prize Winner’s credit
must be approved by GMAC. Not all applicants will qualify. Grand Prize Winner shall be responsible for any excess mileage (over 20,000) and excess wear and tear of
the Lease Vehicle and shall be subject all other terms and conditions of such lease
agreement, which Grand Prize Winner will be required to sign prior to taking vehicle
delivery. In addition, Grand Prize Winner must read and sign all required waiver and
prize release forms and show valid government-issued photo identification showing
date of birth in order to claim the prize. If Grand Prize Winner is not approved by GMAC as a lessee or if Grand Prize Winner is approved by GMAC as a lessee but
nonetheless desires to decline the Grand Prize lease, then Grand Prize Winner may
elect to receive a $5,000 cash prize in lieu of such lease (“Alternative Cash Prize”)
3. Prizes:
a. Grand Prize: There will be one (1) Grand Prize awarded. The Grand Prize is a 2 year lease on a 2008 Pontiac Solstice and an approximate retail value of the lease of $9074.00. The depiction of the Grand Prize vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the winner. If such prize winner does not meet such minimum lease qualification requirements or if such prize winner does meet such minimum lease qualification requirements but desires to decline the lease, then such prize winner may elect to receive a $5000.00 cash prize in lieu of the Lease.
b. The Grand Prize winner shall be solely responsible for all taxes
license, title and registration fees or other costs and expenses associated with transferring and winning The Grand Prize winner shall bear all risk of loss or damage to the Grand Prize lease vehicle after it has been delivered to the specified delivery sit. The Grand Prize winner must personally retrieve the Grand Prize lease vehicle with thirty (30) days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance (or an alternative winner shall be selected and the original Grand Prize winner’s rights to the Grand Prize lease vehicle shall be automatically forfeited). The Lease Vehicle will be delivered solely with the express written limited warranties set forth in the Lease Vehicle’s applicable Owner’s Guide which warranties shall run for the term set forth in said Guide. Borcherding shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the prizes provided pursuant to the Sweepstakes and/or any person’s participation in the Sweepstakes.
c. There is no substitution, transfer, or cash equivalent for prizes, other than the
Alternative Cash Prize, except that Sponsor may, at its sole discretion, substitute
prizes of comparable value or cash. The prizes are expressly limited to the items
listed above and do not include taxes, gratuities or any other expenses. Other
restrictions may apply.
4. Selection of Winners:
a. Decisions of Borcherding management with respect to the contest are final.
b. There will be a reverse drawing held on May 3, 2008. Qualifiers must be present to win. All qualifiers who attend grand prize giveaway will present their golden ticket at time of giveaway at approximately 12pm-2pm. A chocolate bar will be given out to the 50 finalists, 16 of the 50 will receive a golden ticket which will place them in a reverse drawing for the grand prize. The last number in the drawing wins the grand prize.
c. In the event the grand prize winner is deemed to be ineligible to win the Grand Prize
for any reason whatsoever (other than for the reasons listed in the last sentence of
section 2(c) above), another random drawing will occur from all remaining eligible
qualifiers.
d. The odds of winning the grand prize depend on the number of qualifying prize
winners who attend grand prize giveaway.
e. Winners must execute and return any required Affidavit of Eligibility/Release of
Liability Prize Acceptance Form within five (5) days of notification attempt or prize
will be forfeited and an alternate winner may be chosen by random drawing from the
remaining qualifiers.
5. Conditions:
a. Payments of all federal, state and local taxes are solely the responsibility of the
Winners. Winners may be required to sign an IRS Form 1099 or the equivalent.
b. Acceptance of a prize constitutes permission for Borcherding and/or their designed
to use the winner’s name, address, photograph, testimonial or other likeness and/or
prize information or personal exposition (and/or any edited portion thereof) for
promotional advertising and/or publicity purposes in any media, now or hereafter
known throughout the world in perpetuity, without compensation or notice to, on
further consent of, to the winner to the extent permitted by law, and where legal
winner shall sign a publicity release prior to acceptance of the prize.
c. Borcherding reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon
announcement. If due to circumstances beyond the control of Borcherding, any event associated with the contest is delayed, rescheduled, postponed, or canceled, Borcherding shall reserve the right but not the obligation to cancel or modify the contest and shall not be required to award a substitute prize.
d. Failure to comply with the contest rules may result in a contestant’s disqualification
solely at the discretion of Borcherding.
e. Borcherding is not responsible for typographical or other errors in the printing, the
offering or the administration of the contest, or in the announcement of a prize.
f. Copies of the written contest rules and a list of winners (when complete) are
available during regular business hours at Borcherding.
g. To receive the name of the winner, send a self addressed, stamped envelope to
Borcherding Enterprises, 9737 Kings Auto Mall Road, Cincinnati, OH 45249.
